Agreement to Terms

Welcome to Machen Academy. By enrolling your student, accessing our facilities, participating in our programs, or using our website, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

About Machen Academy

Machen Academy is a private K-12 educational academy providing home learning support, comprehensive curriculum, and arts-focused programs to families. We partner with parents as primary educators to deliver quality educational experiences.

Enrollment and Admission

Application Process

Enrollment is subject to availability and completion of all required forms
All information provided during the application process must be accurate and complete
The academy reserves the right to accept or decline enrollment applications
Acceptance is granted on an annual basis and does not guarantee continued enrollment

Age Requirements

Students must meet the age requirements for their grade level as determined by the academy and state guidelines.

Tuition and Fees

Payment Terms

Tuition and fees are due according to the payment schedule provided at enrollment
Late payments may result in late fees or suspension of services
All fees are non-refundable unless otherwise stated in writing
The academy reserves the right to adjust tuition rates annually

Refund Policy

Registration fees are non-refundable
Tuition refunds are subject to the academy's withdrawal policy
Requests for refunds must be made in writing
Refunds, if applicable, will be processed within 30 days

Family Responsibilities

Parent/Guardian Obligations

As a partner in your child's education, parents/guardians agree to:

Serve as the primary educator and oversee home learning
Ensure student attendance at scheduled workshops and events
Complete required assignments and assessments
Maintain open communication with academy staff
Support the academy's educational philosophy and values
Provide accurate and updated contact information
Comply with all academy policies and procedures

Student Conduct

Students are expected to:

Treat staff, other students, and families with respect
Follow academy rules and guidelines
Participate actively in programs and activities
Take care of academy property and materials
Maintain academic integrity

Attendance and Participation

Regular participation in scheduled activities is expected
Families must notify the academy of absences in advance when possible
Excessive absences may affect student progress and continued enrollment
Make-up work policies will be communicated by instructors

Curriculum and Materials

The academy provides curriculum guidance and educational resources
Families are responsible for implementing the curriculum at home
Materials provided remain the property of the academy unless otherwise stated
Borrowed materials must be returned in good condition
Lost or damaged materials may incur replacement fees

Health and Safety

Medical Information

Families must provide accurate medical information and emergency contacts
Parents must notify the academy of any health conditions affecting participation
Required immunization records must be on file
Sick students should not attend in-person activities

Emergency Procedures

The academy maintains emergency procedures for all facilities
Staff will contact parents/guardians in case of emergency
Parents authorize emergency medical treatment if they cannot be reached

Facility Use

Families must follow all facility rules and safety guidelines
Supervision of students is the responsibility of parents/guardians
The academy is not responsible for personal property brought to facilities

Intellectual Property

All curriculum, materials, and content provided by the academy are protected by copyright
Materials may not be reproduced, distributed, or sold without permission
Student work may be displayed or published with parental consent

Photography and Media

The academy may photograph or video students during activities for promotional purposes
Parents may opt out of media use by notifying the academy in writing
Parents may not photograph other students without permission from their families

Communication

Official communications will be sent via email, phone, or through our website
Families are responsible for reading and responding to communications promptly
Questions or concerns should be directed to appropriate staff members

Withdrawal and Termination

Voluntary Withdrawal

Parents may withdraw students at any time with written notice
Refunds will be issued according to our refund policy
All academy materials must be returned upon withdrawal
Outstanding fees must be paid before withdrawal is complete

Involuntary Termination

The academy reserves the right to terminate enrollment for:

Non-payment of tuition or fees
Violation of academy policies
Behavior that threatens the safety or wellbeing of others
Lack of parent/guardian cooperation or compliance
Misrepresentation of information

Limitation of Liability

To the fullest extent permitted by law:

The academy is not liable for injuries occurring outside of supervised academy activities
Parents/guardians assume responsibility for their child's actions
The academy's liability is limited to direct damages only
The academy is not responsible for loss or theft of personal property

Indemnification

Families agree to indemnify and hold harmless Machen Academy, its staff, and volunteers from any claims, damages, or expenses arising from:

Student conduct or actions
Violation of these Terms
Infringement of third-party rights

Dispute Resolution

Concerns should first be addressed with the appropriate staff member
Unresolved issues may be escalated to academy administration
Disputes will be resolved through good-faith negotiation when possible
Legal disputes shall be governed by the laws of Alabama

Website Use

Acceptable Use

The website is for informational and educational purposes
Users may not attempt to hack, disrupt, or damage the website
Users may not use the website for any illegal purpose
We reserve the right to restrict access to the website

User Content

Any content you submit through forms becomes academy property
You grant us the right to use submitted information for academy purposes
You are responsible for the accuracy of information you provide

Modifications to Terms

Machen Academy reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued enrollment or use of services constitutes acceptance of modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, along with our Privacy Policy and Non-Discrimination Policy, constitute the entire agreement between families and Machen Academy.
